Terms of Service

1. Acceptance of Terms & Operating Entity

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer", "You", or "Agency") and Orbit Security Operations ("Orbit Security", "We", "Us", or "Our"), operated by Carson Haynes. By accessing our platform, utilizing the Orbit Recon CLI, requesting automated domain audits, or subscribing to our white-label sentinel retainers, you agree to be bound by these Terms and all applicable local, national, and international laws.

2. Scope & Nature of Services

Orbit Security provides automated, non-intrusive external attack surface hygiene, DNS configuration monitoring, subdomain takeover detection, and white-label co-branded executive PDF audit generation specifically engineered for digital web design, development, and Shopify agencies.

3. Customer Authorization & Target Domain Warranty

To maintain strict compliance with the Computer Fraud and Abuse Act (18 U.S.C. § 1030) and international computer misuse statutes, Customer explicitly represents, warrants, and covenants that:

• Customer is the legal owner or registered administrator of any target domain entered for scanning, OR Customer is an authorized digital agency, managed service provider (MSP), or IT contractor with express or contractual authority to monitor and maintain the digital perimeter hygiene of said client domain.
• Customer shall not submit target domains belonging to third parties without authorization for harassment, competitive espionage, or malicious intelligence gathering.
• Customer indemnifies and holds harmless Orbit Security and its operators against any third-party claims, inquiries, or regulatory actions arising from Customer's unauthorized submission of target domains.

4. White-Label Licensing & Commercial Deliverables

Active subscribers to Orbit Security retainer plans (Starter, Growth, Pro) are granted a perpetual, worldwide, royalty-free commercial license to customize, co-brand with agency logos and corporate color palettes, package, and distribute generated monthly executive PDF security audits to their direct clients as part of paid website maintenance retainers or security stewardship plans.

Orbit Security claims zero intellectual property or copyright over custom-generated client audit PDFs and grants agencies full authorization to market these audits under their proprietary agency care plan branding.

5. Subscription Fees, Billing & Stripe Processing

All subscription payments are securely processed via Stripe using 256-bit encryption. Subscriptions renew automatically on a monthly recurring basis at the selected tier rate ($29/mo, $59/mo, or $99/mo) until canceled. Customer may cancel subscription renewal at any time with one click through the automated Stripe Customer Portal link provided in each invoice or by notifying support.

6. Disclaimer of Security Warranties & Limitation of Liability

Orbit Security is a specialized external posture and hygiene sentinel. It is provided on an "as-is" and "as-available" basis. While Orbit Security significantly reduces the risk of common perimeter blunders (dangling CNAME takeovers, missing DMARC/SPF policies, and exposed dotfiles), it does not guarantee that client systems are completely invulnerable to zero-day exploits, internal network compromise, or targeted advanced persistent threats (APTs). Orbit Security does not replace mandatory human application audits, code reviews, or SOC-2 compliance frameworks.

To the maximum extent permitted by applicable law, Orbit Security's total aggregate liability arising out of or related to these services shall not exceed the total fees actually paid by Customer to Orbit Security during the twelve (12) month period immediately preceding the event giving rise to liability.

7. Modifications & Termination

We reserve the right to modify these Terms to reflect technical updates, statutory requirements, or commercial enhancements. Continued use of Orbit Security following notice of changes constitutes acceptance. We reserve the right to suspend or terminate accounts that violate safe harbor guidelines or abuse automated scanning endpoints.
